These Terms of Service ("Terms") govern your access to and use of the AI Smart Events / FaceLink platform and related services (the "Service"). By creating an account, creating an event, uploading photos, or otherwise using the Service, you agree to be bound by these Terms.

1. Using the Service

• You are responsible for all activity that occurs under your account.
• You agree to provide accurate information and to keep your login details secure.
• You agree not to misuse the Service, including by attempting to interfere with its normal operation, reverse‑engineering, or accessing it using automated means not explicitly permitted.

2. Event Owners & Guests

Event owners create and manage events, upload or import photos, and share access links and PINs with their guests. Guests may upload photos or search for photos of themselves, subject to the settings chosen by the event owner.

• Event owners are responsible for ensuring they have the right to upload and share photos and for complying with applicable laws (including privacy and image rights).
• Guests should only upload photos they have permission to share and must not upload illegal, harmful or abusive content.

3. Photo Content & Permissions

• You retain all rights in the photos you upload or import.
• By using the Service, you grant us a limited, non‑exclusive licence to host, process, display and create technical derivatives of your photos (thumbnails, compressed copies, embeddings for search) solely to provide and improve the Service.
• You confirm that you have obtained any required permissions from individuals appearing in your photos to use their images in this way.

4. Face Matching & Search

The Service may use face recognition or face‑matching technology to help guests find their own photos. This functionality is enabled per‑event by the event owner.

• Face embeddings and similar technical data are used only to provide search and grouping features inside the relevant event.
• We do not provide a general‑purpose biometric identification service.

5. Third‑Party Services (Google Drive & Google Photos)

If you connect a third‑party service (such as Google Drive or Google Photos), you authorise us to access that service in accordance with the permissions you grant.

• We use this access only to read and copy photos you choose into your events; we do not modify or delete content in your external accounts.
• You are responsible for complying with the third‑party service’s own terms and policies.

6. Prohibited Content

You agree not to upload, import or share any content that:

• Violates any law or regulation.
• Infringes intellectual property, privacy, or publicity rights of others.
• Is hateful, harassing, threatening, or otherwise harmful.
• Contains sexually explicit material involving minors or any form of exploitation.

We may remove content or suspend access where we reasonably believe these Terms are violated.

7. Availability & Changes

We aim to keep the Service reliable, but we do not guarantee uninterrupted or error‑free operation. We may modify, suspend or discontinue features at any time, with or without notice, including for maintenance, upgrades or security reasons.

8. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

9. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claims relating to the Service will be limited to the amount you have paid us for the Service in the twelve (12) months preceding the event giving rise to the claim, or, if you use the Service under a free plan, to a reasonable amount not exceeding the equivalent of one (1) month of paid service fees for the relevant plan.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service if you violate these Terms, misuse the platform, or where required by law or to protect other users.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after any changes means you accept the revised Terms.
